Michel Foucault’s notion of “biopower” has been a highly fertile concept in recent theory, influencing thinkers worldwide across a variety of disciplines and concerns. In The History of Sexuality: An Introduction, Foucault famously employed the term to describe “a power bent on generating forces, making them grow, and ordering them, rather than one dedicated to impeding them, making them submit, or destroying them.” With this volume, Vernon W. Cisney and Nicolae Morar bring together leading contemporary scholars to explore (...) the many theoretical possibilities that the concept of biopower has enabled while at the same time pinpointing their most important shared resonances. Situating biopower as a radical alternative to traditional conceptions of power—what Foucault called “sovereign power”—the contributors examine a host of matters centered on life, the body, and the subject as a living citizen. Altogether, they pay testament to the lasting relevance of biopower in some of our most important contemporary debates on issues ranging from health care rights to immigration laws, HIV prevention discourse, genomics medicine, and many other topics. Published in 1967, Voice and Phenomenon marked a crucial turning point in Derrida's thinking: the culmination of a 15-year-long engagement with the phenomenological tradition. It also introduced the concepts and themes that would become deconstruction. Voice and Phenomenon is a short book, but it can be an overwhelming text, particularly for inexperienced readers of Derrida's work. This is the first guide to clearly explain the structure of his argument, step by step.

In this paper I employ the notion of the ‘thought of the outside’ as developed by Michel Foucault, in order to defend the philosophy of Gilles Deleuze against the criticisms of ‘elitism,’ ‘aristocratism,’ and ‘political indifference’—famously leveled by Alain Badiou and Peter Hallward. First, I argue that their charges of a theophanic conception of Being, which ground the broader political claims, derive from a misunderstanding of Deleuze’s notion of univocity, as well as a failure to recognize the significance of the (...) concept of multiplicity in Deleuze’s thinking. From here, I go on to discuss Deleuze’s articulation of the ‘dogmatic image of thought,’ which, insofar as it takes ‘recognition’ as its model, can only ever think what is already solidified and sedimented as true, in light of existing structures and institutions of power. Then, I examine Deleuze’s reading of Foucault and the notion of the ‘thought of the outside,’ showing the ‘outside’ as the unthought that lies at the heart of thinking itself, as both its condition and its impossibility. Insofar as it is essential to thinking itself, finally, I argue that the passage of thought to the outside is not an absolute flight out of this world, as Hallward claims, but rather, a return of the different that constitutes the Self for Deleuze. Thinking is an ongoing movement of deterritorialization and reterritorialization, or as Foucault says, death and life. Thinking, as Deleuze understands it, is essentially creative; it reconfigures the virtual, thereby literally changing the world. Thinking is therefore, according to Deleuze, thoroughly political. In this paper I explore two distinct but related emphases in Deleuze's later philosophy, both on his own and in collaboration with Félix Guattari, having to do with literature. The first is the emphasis on the work of literature as an assemblage whereby the author constructs lines of flight in the pursuit of self-experimentation and self-transformation. The second is the rejection of metaphor across Deleuze's work. I use Difference and Repetition to chart the origins of these emphases, by unpacking the (...) metaphysics of language contained in Difference and Repetition. I first recount the basic structure of Deleuze's intensive ontology, before going on to discuss the way in which the ‘fundamental encounter’ forces thought to formulate Ideas, which, as they are transmitted through the subject, alter her nature. This self-transformation is tantamount to a kind of ‘death’, whereby one is continually explicated, but this explication implies the transcendental Other-structure at the end of Difference and Repetition, wherein the Other, through language, gives birth to ‘possible worlds’. I end with the development of an unexplored concept in Difference and Repetition, the loquendum, which is what must be spoken precisely because it is inexpressible, the purely intensive. Language comes closest to this intensive use in its aesthetic, poetic, literary modes whereby authors distort their own languages. (shrink)

In this essay, we read Derrida’s Theory and Practice seminar against the backdrop of the theme of the “death of philosophy,” prominent in 1960s French philosophy. This theme takes two forms—one Nietzschean-Heideggerian and the other Hegelian-Marxian. We summarize both before turning to Derrida’s treatment of Althusser’s views on the Hegelian-Marxian form of this death. Althusser posits a distinction between theory in the general sense and Theory as a designation for Marxist dialectical materialism. Derrida gives two specific criticisms of Althusser that (...) we discuss: (1) Althusser commits himself to a tautology, by arguing that Theory only makes explicit what is implicit already in Marxist practice; (2) Althusser ultimately establishes the priority of practice over theory. We refute both of these charges before concluding that, prior to the distinction between theory and practice, is the world itself; and presenting itself to us as unthinkable, the world places the demands upon us that it be engaged with, in theory and in practice. In this paper, I trace the concept of ‘becomings’, most thoroughly articulated in the tenth plateau of A Thousand Plateaus, as it relates to the notion of the writer as sorcerer. More precisely, my aim is to articulate how it is that Deleuze and Guattari conceptualise the writer as really effecting what they understand as ‘becomings’. My thesis is that if the writer is a sorcerer, capable of enabling real becomings, it is because language itself, for Deleuze and Guattari, is (...) bodily and material, and the author, particularly the literary author, has the ability to disrupt language's representational domain of sense, causing language to hum with the intensive vitality that puts it in closest proximity to the body, from whence language emerges in the first place. We shall first look to Bergson and Spinoza, from whom Deleuze and Guattari abstract their intensive conception of the body in A Thousand Plateaus. From here we will outline the apparent progression of becomings in the tenth plateau. Finally, we will look to the Kafka book as outlining the material and affective capacities of literature. Shuman Questions of responsibility for serious harm are complex and potentially divisive. The way in which we frame these questions and the criteria by which we assess answers to them are colored, in part, by the lens though which we view them. I am a law (...) professor whose writings includes issues relating to criminal responsibility of person with mentally disabilities and I come to this commentary from that perspective. For me questions of moral responsibility raise psychological and philosophical, as well as legal, questions.Ciocchetti's (2003) paper addressees the criminal responsibility of the psychopathic offender. Not sure quite what the author meant by this label, I began to try to understand the concept of psychopathic offender by picking up my DSM-IV-TR and found no reference to such a diagnostic category. Absent a handy reference in the DSM, I looked in the paper for some other definition or recognition of the category of psychopathic offender and found no satisfactory grounding in any body of sound research. Left with the author's unsupported assertions that such a category of persons exists and that they behave in ways the author asks me to accept without support, my lawyer instincts cautioned me to proceed carefully. The psychopathic offender the author describes might well exist, but I am not persuaded of that, nor would be my legal colleagues, absent proof.Next, to the author's thesis that "[t]he offender must have the capacities necessary to understand relationships to justify holding that offender responsible" (p. 176) and that because psychopaths lack this capacity they should not be held criminally responsible. Is the author proposing a new test for criminal responsibility? Certainly no test for criminal nonresponsibility based on mental disability (i.e., insanity defense) in Anglo-American jurisprudence, or any other with which I am familiar, makes status (i.e., a diagnostic category) exculpatory for criminal responsibility. Rather, every test addresses the impact of a mental illness or disorder on the cognitive or volitional capacity of the offender at the time of the offense. The author offers no reason to reject the approach taken for the last several hundred years [End Page 193] by Anglo-American jurisprudence. Moreover, to the extent that status or diagnostic category is relevant in the insanity defense in Anglo-American jurisprudence, character or personality disorders (the genus to which I take it that psychopathy belongs) are often specifically excluded from consideration. For example, the Texas Penal Code (Tex. Penal Code Ann. § 8.01 (Vernon 1994)) states that:It is an affirmative defense to prosecution that, at the time of the conduct charged, the actor, as a result of a severe mental disease or defect, did not know that his conduct was wrong. The term "mental disease or defect" does not include an abnormality manifested only by repeated criminal or otherwise antisocial conduct.The federal Insanity Defense Reform Act raises the same issue: The government relies on the legislative history of 18 U.S.C. § 17, which states: "The concept of severity was added to emphasize that non-psychotic behavior disorders or neuroses such as an 'inadequate personality,' 'immature personality,' or a pattern of 'antisocial tendencies' do not constitute the defense.".... The government argues that because Dr. Lorenz would have testified that Salava was not psychotic but suffered from antisocial personality disorder, his testimony was not relevant to either prong of the insanity defense under the statute.... As a general matter, the government's point is well-taken. It seems clear that Congress intended by its inclusion of the modifier "severe" to place certain "disorders" outside the purview of the insanity defense altogether. United States v. Ethical conflicts have always been connected with new techniques of reproductive medicine such as in-vitro fertilization. The fundamental question is: When does human life begin and from which stage of development should the embryo be protected? This question cannot be solved by scientific findings only. In prenatal ontogenesis there is no moment during the development from the fertilized oocyte to a human being which could be recognized as an orientation point for all ethical problems connected with the question of the (...) right to dispose of prenatal life (interruption of pregnancy, research on embryos). The protection of an individual human life must be valid for all in the same manner and from the very beginning on. It must not depend on value judgments or on stages of development, so-called grades of humanity, because these would then become selection criteria. Procreated life must have the right to be born. These were the essential ethical arguments which led to the German Embryo Protection Law. (shrink)

The questions that my paper shall pursue are: 1) What path leads from Deleuze’s early writings to his latter-day conception of a life, and 2) What can such a conception of life mean? Our path will trace a reversal and a return, respectively, through phenomenology to Bergson. For Deleuze, a genuine concept of a life is thinkable, only when the phenomenological subject, which Deleuze considers an illusion, has been jettisoned, reabsorbed into the flux of immanence. This essay is an exploration of the relationship between Agamben's 1995 text, Homo Sacer, and Derrida's 1992 “Force of Law” essay. Agamben attempts to show that the camp, as the topological space of the state of exception, has become the biopolitical paradigm for modernity. He draws this conclusion on the basis of a distinction, which he finds in an essay by Walter Benjamin, between categories of life, with the “pro‐tagonist” of the work being what he calls homo sacer, or bare (...) life—life that is stripped of its humanity and value. Five years earlier, in 1990, Derrida had given a lecture at UCLA (later published in its entirety as “The Force of Law”) in which he had analyzed the very same essay by Benjamin and had highlighted the distinction between “base life” and “just life.” The implications of his analysis show a discomforting prox‐imity between Benjaminian messianism and the Nazi “final solution,” a conclusion that Agamben dismisses entirely. In this paper, however, I demonstrate that the structures of the two works are quite similar in many important ways. I argue that, though the broad scope of Agamben's work is original in many respects, and I would not wish to reduce Agamben's work to Derridean repetitions, he nevertheless utilizes much more of Derrida's analysis, specifically with respect to the categori‐zation of life, than he would like the reader to believe. Philosophy’s richness comes in part from the wide range of conceptual frameworks from which meaning can be made of aspects of the world. Philosophy can be done from feminist, Marxist, positivist, or Freudian standpoints. The difference in the sorts of analyses produced by these different approaches can be tricky to explain to undergraduates. Contained here are short explanations of the nature of a collection of these frameworks and a fun example of each, an analysis of the chicken crossing the road (...) joke to be used to give undergraduates a sense of the breadth of philosophical methodology. Benedict de Spinoza, C.S. Peirce, and Gilles Deleuze delineate a trajectory through the history of ideas in the dialogue about the potentials and limitations of panpsychism, the view that world is fundamentally made up of mind. As a parallel trajectory to the panpsychism debate in contemporary philosophy of mind and cognitive psychology, this approach can inform and enrich the discussion of the role and scope of mind in the natural world. Die bei Krebserkrankungen junger Frauen erforderliche Chemo- bzw. Strahlentherapie kann in der Folge bei den betroffenen Patientinnen zur Unfruchtbarkeit führen. Somit werden die Betroffenen oft gleichzeitig mit einer potentiell lebensbedrohlichen Erkrankung und einem potentiell kinderlosen Leben konfrontiert. Die derzeitigen Methoden zum Erhalt der Fertilität sind experimentell, mit therapeutischer Unsicherheit und gesundheitlichen Risiken belastet, dennoch werden sie zunehmend nachgefragt. Die mit dem Angebot fertilitätserhaltender Maßnahmen verbundene derzeitige Beratungspraxis wird in dem hier vorliegenden Beitrag aus ethischer Perspektive hinterfragt. Ausgehend von einer kritischen (...) Würdigung des nach wie vor häufig angewandten Autonomiekonzepts von Beauchamp und Childress wird diskutiert, auf welche Weise die normative Belastbarkeit der Entscheidungsfindung durch die Vulnerabilität der Patientin limitiert sein kann. Als Alternative zum Autonomiekonzept von Beauchamp und Childress wird anschließend eine Entscheidungsfindung auf der Grundlage biographischer Identität in Anlehnung an das Konzept der personalen Autonomie nach Quante erörtert. The Research Excellence Framework of the Higher Education Funding Council for England is taking place in 2013, its three key elements being outputs, impact, and “quality of the research environment”. Impact will be assessed using case studies that “may include any social, economic or cultural impact or benefit beyond academia that has taken place during the assessment period.”1 Medical ethics in the UK still does not have its own cognate assessment panel—for example, bioethics or applied ethics—unlike in, for example, Australia. (...) Several researchers in medical ethics have reported to the Institute of Medical Ethics that during the internal preliminary stage of the Research Excellence Framework several medical schools have decided to include only research that entails empirical data gathering. Thus, conceptual papers and ethical analysis will be excluded. The arbitrary exclusion of reasoned discussion of medical ethics issues as a proper subject for medical research unless it is based on empirical data gathering is conceptually mistaken. “Empirical ethics” is, of course, a legitimate component of medical ethics research, but to act as though it is the only legitimate component suggests, at best, a partial understanding of the nature of ethics in general and medical ethics in particular. It also mistakenly places medicine firmly on only one side of the science/humanities “two cultures” divide instead of in its rightful place bridging the divide. Given the emphasis by the General Medical Council on medical ethics in properly preparing “tomorrow’s doctors,” we urge medical schools to find a way of using the upcoming Research Excellence Framework to highlight the expertise residing in their ethicist colleagues. We are confident that appropriate assessment will reveal work of high quality that can be shown to have social and cultural impact and benefit beyond academia, as required by the framework. (shrink)

Military and defense-related procurement has been an important source of technology development across a broad spectrum of industries that account for an important share of United States industrial production. In this book, the author focuses on six general-purpose technologies: interchangeable parts and mass production; military and commercial aircraft; nuclear energy and electric power; computers and semiconductors; the INTERNET; and the space industries. In each of these industries, technology development would have occurred more slowly, and in some case much more slowly (...) or not at all, in the absence of military and defense-related procurement. The book addresses three questions that have significant implications for the future growth of the United States economy. One is whether changes in the structure of the United States economy and of the defense-industrial base preclude military and defense-related procurement from playing the role in the development of advanced technology in the future, comparable to the role it has played in the past. A second question is whether public support for commercially oriented research and development will become an important source of new general-purpose technologies. A third and more disturbing question is whether a major war, or the threat of major war, will be necessary to mobilize the scientific, technical, and financial resources necessary to induce the development of new general-purpose technologies. When the history of United States technology development in the next half century is written, it will focus on incremental rather than revolutionary changes in both military and commercial technology. It will also be written within the context of slower productivity growth than of the relatively high rates that prevailed in the United States in the 1950s and 1960s or during the information technology bubble that began in the early 1990s. These will impose severe constraints on the capacity of the United States to sustain a global-class military posture and a position of leadership in the global economy. (shrink)

In this analysis we discuss the change in criteria for triage of patients during three different phases of a pandemic like COVID-19, seen from the critical care point of view. Availability of critical care beds has become a hot topic, and in many countries, we have seen a huge increase in the provision of temporary intensive care bed capacity. However, there is a limit where the hospitals may run out of resources to provide critical care, which is heavily dependent on (...) trained staff, just-in-time supply chains for clinical consumables and drugs and advanced equipment. In the first phase, we can still do clinical prioritisation and decision-making as usual, based on the need for intensive care and prognostication: what are the odds for a good result with regard to survival and quality of life. In the next, the resources are mostly available, but the system is stressed by many patients arriving over a short time period and auxiliary beds in different places in the hospital being used. We may have to abandon admittance of patients with doubtful prognosis. In the last phase, usual medical triage and priority setting may not be sufficient to decrease inflow and there may not be enough intensive care unit beds available. In this phase different criteria must be applied using a utilitarian approach for triage. We argue that this is an important transition where society, and not physicians, must provide guidance to support triage that is no longer based on medical priorities alone. (shrink)

Taking advantage of this boom in anarchist scholarship, Nathan J. Jun and Shane Wahl have compiled twenty-six cutting-edge essays on this timely topic in New Perspectives on Anarchism.

The Global Workspace Theory and Information Integration Theory are two of the most currently accepted consciousness models; however, these models do not address many aspects of conscious experience. We compare these models to our previously proposed consciousness model in which the thalamus fills-in processed sensory information from corticothalamic feedback loops within a proposed 3D default space, resulting in the recreation of the internal and external worlds within the mind. This 3D default space is composed of all cells of the body, (...) which communicate via gap junctions and electrical potentials to create this unified space. We use 3D llustrations to explain how both visual and non-visual sensory information may be filled-in within this dynamic space, creating a unified seamless conscious experience. This neural sensory memory space is likely generated by baseline neural oscillatory activity from the default mode network, other salient networks, brainstem, and reticular activating system. (shrink)
